Understanding Mediation

Most people assume that mediation means that an impartial person listens and offers advice to couples in an attempt to try and work through their differences and problems with them so that they can remain together.

Although there are various organisations that provide this type of advice and help to couples, this is not mediation. Most couples have already attempted to sort out their problems between themselves and for many, separation or divorce is the next step. Mediation is a mechanism for couples to reach a resolution of any issue arising out of their relationship including children and finance and is now becoming an increasingly popular way of resolving matrimonial difficulties whether before or after a separation or divorce. If both parties are committed to trying to reach a compromise it can be an extremely cost effective and quick way to achieve a final agreement for both parties. Important matters such as children’s welfare and financial provision are resolved quicker, minimizing any unnecessary distress or upset for all concerned.

What will happen in Mediation?

Whether a situation is amicable or contentious, mediation can help. Both or each of the parties separately will discuss their position on the above issues with the mediator. After discussions between the parties with the help of a mediator resolutions are finally reached that are acceptable to both sides. It is at this stage that we will draft the necessary paperwork for the Court to implement the decisions agreed between the parties.
